By using this website you indicate your acceptance, using any other acceptance method provided through the Service (as defined below), or otherwise affirmatively accepting these terms and conditions, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms and conditions, please do not use this website.
Arbitration Notice: Unless you opt out of arbitration as outlined in these terms, you agree that disputes between you and us or between you and the medical groups or providers related to these terms or the Service will be resolved through binding individual arbitration. You waive your rights to a jury trial and to participate in a class action lawsuit or class-wide arbitration, as detailed below. We provide further information on exceptions and how to opt out of arbitration.
Medical Disclaimer: If you have a medical emergency, seek immediate in-person care or call 911. The Service may not be suitable for all medical conditions or concerns. This Agreement is subject to change as outlined below.
Barrie Wellness NP in Family Health, and/or its subsidiaries (collectively, “Wake Up To Afiya & Wellness” “Sistah Pause,” “we,” or “us”) own and operate the website located at www.sistahpause.com and may now or in the future own and/or operate a “Sistah Pause” mobile application (collectively, the “Platform”). Your access to and use of the Platform, any part of it, or anything associated with it, including its content (“Content”), any products or services provided through the Platform or otherwise by Sistah Pause, and any affiliated website, software, or application owned or operated by Sistah Pause (collectively, including the Platform and Content, the “Service”), are governed by these Terms and Conditions (“Terms and Conditions” or “Agreement”).
Please read this Agreement carefully, as it outlines important terms you need to know about the Service. In this Agreement, “you” and “yours” refer to the individual using the Service.
Acceptance of Terms and Conditions
Your access to and use of the Service is governed by this Agreement, along with all applicable laws and regulations. If you do not fully accept and agree to be bound by this Agreement, you are prohibited from visiting, accessing, registering, or using the Service or any information or content provided through it, except as necessary to review the Agreement. The Service is continually evolving, and we reserve the right to modify or remove any part of this Agreement or the Service at any time, without prior notice. Any changes to this Agreement take effect immediately upon being posted on the Platform. Unless otherwise noted, any new content added to the Service is also subject to this Agreement once posted. If you disagree with the terms of this Agreement, your sole recourse is to stop using the Service. Continued use of the Service after changes to this Agreement are posted signifies your acceptance of the modified terms.
You agree not to use the Website Content or any services provided by Sistah Pause in any unlawful manner, for any illegitimate purpose, or in violation of our policies, guidelines, rules, or the terms and conditions of this Agreement. This includes, but is not limited to, the following actions:
You will not post or transmit messages or information under a false identity to mislead others or impersonate any entity, including any representative of Sistah Pause.
You will not engage in unauthorized credit card use.
You will not post or transmit information that is unlawful, defamatory, obscene, fraudulent, harassing, threatening, predatory towards minors, or abusive.
You will not post or transmit content that infringes on the intellectual property, privacy, or proprietary rights of others.
You will not attempt to disrupt our operations by using methods such as viruses, Trojan horses, worms, time bombs, denial of service attacks, flooding, spamming, or any other harmful programs that could damage the computing devices or property of others.
You will not upload or transmit unsolicited advertising, promotional materials, junk mail, spam, or other forms of solicitation, commercial or otherwise.
You will not use any of our tools or services in a way that could damage, disable, or impair our services or networks.
You will not attempt to gain unauthorized access to any user or customer accounts, computer systems, or networks through hacking, password mining, or any other means.
You will not use robots, scrapers, or other automated or manual means to access any part of our website or systems for any purpose.
You will not harvest or collect information about others, including names, addresses, or email addresses, without their consent.
You will not modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Website, nor assist anyone else in doing so.
Your Relationship with Us
We provide certain products and services to individuals who register as users of the Service (“Users”). These products and services may be sold or offered by Sistah Pause or by third-party providers, pharmacies, or other vendors. The Service grants you access to prescription fulfillment services offered by pharmacies, including those like Hallandale Compounding Pharmacy (“Pharmacies”). We also offer access to healthcare services provided by our employed or contracted physicians, Nurse Practitioners, nurses, and other healthcare professionals to provide healthcare services through the Platform (“Providers”). By accepting this Agreement, you agree that any services received from Pharmacies, Medical Staff/Group, or Providers through the Platform are also governed by this Agreement, and they are third-party beneficiaries of these terms.
We do not interfere with or control the practice of medicine by Medical Staff or Providers. Each Provider is fully responsible for directing your care. By accepting this Agreement, you acknowledge that Sistah Pause is not a healthcare provider, and using the Service does not create a doctor-patient or healthcare provider-patient relationship with Sistah Pause. However, by using the Service, you may enter into a doctor-patient or healthcare provider-patient relationship with a Medical Group or Provider. Similarly, we do not interfere with professional services provided by Pharmacies, which are solely responsible for their services offered through the Service.
By accepting this Agreement, you agree that Medical Groups and Providers may send you communications, including messages, reports, and emails, about your diagnosis and treatment via the Service. You understand that Sistah Pause is not responsible for the security or privacy of the communications systems you use to receive these communications. It is your responsibility to monitor and respond to these messages, and neither Sistah Pause nor the Medical Groups nor Providers will be held responsible for any failure on your part to respond or follow treatment recommendations.
Although using the Service does not establish a healthcare relationship with Sistah Pause, you are establishing a customer relationship with us for the purposes of using the Service, including purchasing non-prescription products or non-medical services. In doing so, you may provide personal and health information, which we handle in accordance with our Privacy Policy. Please see the “Privacy Policy” section for more details.
Notice Regarding Financial Responsibility for Services
Sistah Pause is not enrolled with, nor participates with any federal or state healthcare programs (e.g., Medicare, Medicaid), and thus cannot receive payment from these programs for services or products offered by Sistah Pause or the Medical Groups. Similarly, Pharmacies or Providers that may be enrolled in these programs cannot provide services or products through the Service that are eligible for reimbursement. By choosing to use the Service, you are specifically opting to obtain products and services outside of federal or state healthcare programs or through limited commercial insurance options, as detailed in the Payment Acknowledgment Form. You are solely responsible for all costs associated with any service or product provided to you.
By agreeing to use the Service, you confirm that (1) you are consciously choosing to obtain products and services outside federal or state healthcare programs or through limited commercial insurance options as described in the Payment Acknowledgment Form, and (2) neither you nor Sistah Pause, the Labs, Pharmacies, Medical Groups, or Providers will submit claims for reimbursement to any federal or state healthcare program for services and products offered through the Service.
Cancellation Policy
Cancellations must be made at least two (2) days prior to the scheduled appointment via the patient portal or email. Cancellations made within 24 hours of the appointment will incur a $75 fee, and no-shows will be charged $150. Two consecutive no-shows without valid reason will result in forfeiture of the full Discovery Call fee with no refunds. Once lab requisitions have been sent, no refunds will be issued. All services and programs provided by Sistah Pause™ are final and non-refundable. You may cancel your appointment by emailing support@sistahpause.com, calling 201-350-7892, or through your online account.
Medication Policy
Upon enrollment in any program, prescribed medications will be sent to the client’s designated local pharmacy or dispensed through one of Sistah Pause’s partnered compounding pharmacies. Enrollment in a program signifies acknowledgment and acceptance that all associated consultation, laboratory, and medication services are part of a comprehensive wellness plan. Sistah Pause™ does not offer refunds for any programs, services, or prescribed medications once enrollment has been completed, and all sales are final.
Important Note on Delays:
Shipments may experience delays or rerouting due to weather or other unforeseen circumstances, but your medication will remain effective. Sistah Pause does not issue refunds for shipping delays that are beyond our control.
Additional Medication Policy:
In rare cases, you may receive medications with a beyond-use date (BUD) that is closer to the expiration date. If this occurs, you may contact the dispensing pharmacy directly to request a replacement in accordance with their policies. If medications are reported as lost, stolen, or not delivered, and the pharmacy confirms that the shipment was sent to the correct address, no refunds or replacements will be issued. It is the client’s responsibility to ensure that accurate shipping information is provided and that deliveries are received promptly at the designated location. Sistah Pause™ does not assume responsibility for packages once they have been verified as delivered by the dispensing pharmacy or carrier.
Subscription Products and Services
Some products and services offered through the Service require a recurring subscription. For subscription-based products and services, your payment method will be automatically charged at regular intervals as specified during checkout, unless you cancel your subscription. To ensure continuity of treatment, your first renewal may be processed early, and subsequent renewals may occur up to two days early to accommodate holidays or operational reasons. You may cancel a subscription by emailing support@sistahpause.com, calling 201-350-7892, or through your online account. Cancellation takes effect at the end of the current subscription period. If you do not cancel at least three days before the renewal date, your subscription will automatically renew. Refunds for unused portions of subscription periods are not offered, although we may consider refunds on a case-by-case basis. We may also offer a pause option for your subscription, and if you do not cancel before the end of the pause period, charges will resume automatically. We may change subscription plans or prices, but you will be notified in advance of any changes.
To streamline the experience, you will only see and pay a single “total” subscription price. However, if a subscription product requires a consultation with a Provider or includes a prescription from a Pharmacy, the total price includes the Service fee, the cost of the prescription drug from the Pharmacy, and the Medical Group's fee for the Provider’s services. These fees are collected on behalf of and paid to the respective Pharmacies and Medical Groups.
Prescription Products
Certain products available on the Platform require a valid prescription from a licensed healthcare provider. You will not receive these prescription products unless you have completed a consultation with a Provider, the Provider deems the product appropriate, and they issue a prescription.
If a Provider writes you a prescription, you will be given information on how to fill it. Some prescriptions can be filled through Pharmacies using the Platform, or you may choose to fill the prescription at another pharmacy of your choice. If you fill a prescription through a Pharmacy on the Platform ( i.e through our compounding pharmacy), the associated costs are included in the total charged by the Service. If you use an outside pharmacy, you are responsible for obtaining and paying for the prescription directly.
Prescription products provided through the Platform are considered “Third-Party Goods and Services” as defined in the relevant section of this Agreement.
Limited Use and Availability
Sistah Pause's services are currently only accessible to individuals who reside in states where the services are available, are at least 18 years old or older, or meet the legal age of majority in their location if that age is higher than 18. By visiting, accessing, registering with, or using the services, you affirm that (a) you are of legal age as per the requirements mentioned; (b) when consulting with a provider, you are physically located in the state matching the shipping address associated with your account; (c) you agree to follow all applicable laws when using the service; and (d) you commit to using the service solely for lawful purposes. Please note that our services are subject to state regulations, which may change over time based on evolving legal requirements.
In some situations, the service might not be the most appropriate way to communicate with or receive care from a healthcare provider. Certain conditions may require an in-person visit or a different healthcare provider. If that is the case, you may be notified that the service is not suitable for your needs, and alternative steps will be provided.
Consent to Use of Telehealth Services
Telehealth involves the provision of healthcare services through electronic communications between you and a healthcare provider in different physical locations. While telehealth can offer certain benefits, there are also potential risks. These services are not a replacement for in-person care in every situation. To use the service, you will be required to review and accept the informed consent agreement provided via the service. Sistah Pause has the right to enforce this agreement.
Duty to Provide Information, Access, and Connectivity
You are responsible for ensuring that you have the necessary software, hardware, and internet access to use the service. This includes a device with a camera and internet connection. Any costs related to internet or mobile data usage are your responsibility. You must also provide accurate and truthful information when filling out forms or communicating through the service. Sistah Pause reserves the right to modify the system requirements at any time without notice.
Privacy Policy
Sistah Pause values your privacy and confidentiality. Please review our Privacy Policy for details on how we collect, use, and protect your personal information.
Protected Health Information
When you create an account with Sistah Pause, you are entering into a direct relationship that allows you to access the services we provide. During this process, you provide personal information like your name, email address, and phone number, which we handle in accordance with our Privacy Policy. However, this is not considered medical or health information.
In using the service, you may share medical information that could be protected under relevant laws. Sistah Pause is not a "covered entity" under the Health Insurance Portability and Accountability Act (HIPAA). However, certain labs, pharmacies, or medical groups may be, and in some cases, Sistah Pause might serve as a "business associate" under HIPAA, which means we may have certain responsibilities regarding your protected health information (PHI). Any medical or health data you provide that is governed by state laws will be handled in accordance with those laws.
The medical groups and providers associated with Sistah Pause have adopted a Notice of Privacy Practices that outlines how your protected health information is used and disclosed. By using our services, you acknowledge receipt of this notice.
Registration; User Accounts, Passwords, and Security
To access the services provided by Sistah Pause, you must create an account by registering with us. During registration, you will be required to provide certain information, such as your name, email address, and phone number. This information will not be considered protected health information unless otherwise specified. You represent and warrant that all information submitted during registration is truthful and accurate, and you agree to keep it up-to-date. You are also responsible for notifying Sistah Pause immediately of any unauthorized use of your account.
When setting up your Customer Account, you will create a username and password or use a one-time passcode sent to your email for authentication. It is your responsibility to maintain the confidentiality of your account login credentials, and you are fully accountable for all activities that occur under your account. You agree to log out after each session to prevent unauthorized access. Sistah Pause is not liable for any loss or damage resulting from your failure to comply with these security requirements.
While we take measures to protect your data, such as employing encryption technologies, you acknowledge that our systems run on hardware and software that may require maintenance or encounter issues beyond our control. Therefore, you are also responsible for securing your devices and account information to protect against unauthorized access or breaches.
Use and Ownership of the Service
The content and services provided by Sistah Pause are protected by copyright laws. We grant you a limited, non-transferable, and revocable license to access and use our services for personal purposes. All rights to the content and services remain with Sistah Pause or its licensors. You may not use, alter, or remove any trademarks or other proprietary notices displayed in connection with the service without permission.
License to Information Submitted via the Service
Any information you submit to Sistah Pause, including comments, questions, or suggestions, will be treated as non-confidential unless otherwise required by law. You grant Sistah Pause the right to use, distribute, and display this information as necessary to operate and provide the service. If the submission contains protected information, its use will be governed by applicable laws.

Prohibited Use
You are prohibited from using or attempting to use the Service: (i) for any illegal, unauthorized, fraudulent, or malicious purpose; (ii) in a way that could harm, disable, overload, or impair any server or network associated with a server; (iii) in any way that could interfere with other users’ access to and enjoyment of the Service; (iv) to gain unauthorized access to any accounts, systems, or networks connected to the Service through hacking, password mining, or other unauthorized means; (v) to access any data or systems not intended for users of Sistah Pause; (vi) to obtain any materials or information through any means not intentionally provided by Sistah Pause; (vii) to reverse-engineer, disassemble, or decompile any part of the Service’s technology; or (viii) for any purpose other than the intended business use of the Service.
Additionally, you agree not to: (a) upload or transmit any unlawful, harmful, offensive, or inappropriate content related to race, gender, sexuality, ethnicity, or other personal characteristics; (b) create false identities or accounts to mislead others or impersonate any person or entity, including a representative of Sistah Pause; (c) upload or transmit material you do not have the legal right to share; (d) upload files containing viruses, spyware, or any other harmful software; (e) delete legal notices or proprietary labels uploaded through any communication feature; (f) use the Service’s communication features in ways that affect other users’ ability to access resources; (g) upload unsolicited advertising or solicitations (e.g., "spam"); (h) violate any local, national, or international laws; (i) upload material infringing any intellectual property rights; (j) delete or edit content posted by others; (k) manipulate the Service’s display using framing or mirroring; (l) test or breach the security measures of the Service; (m) register others for services or promotions without their permission; (n) collect information about other users, including email addresses; or (o) use automated methods (e.g., robots or scrapers) to access, copy, or distribute content from the Service.
Sistah Pause reserves the right to take legal action in response to any violations of these terms, including suspending or terminating user access. Sistah Pause may cooperate with law enforcement or third parties in investigating suspected violations.
Except as outlined in the Privacy Policy or required by law, Sistah Pause reserves the right to disclose any information as necessary to comply with laws or legal requests, and to edit, refuse to post, or remove content at its discretion.
Right to Monitor
Sistah Pause reserves the right to monitor use of the Service and remove any materials that are illegal, violate this agreement, or are inconsistent with the Service’s purpose.
Third-Party Goods and Services
Third parties, including labs, pharmacies, and providers, offer products and services through Sistah Pause (collectively, “Third Parties”). Any interactions, including payments, between you and these Third Parties are solely between you and the Third Parties. You should take necessary precautions before entering transactions with Third Parties. Sistah Pause is not liable for any loss or damage resulting from interactions with Third Parties, and Sistah Pause is not obligated to resolve disputes between users and Third Parties.
Terms of Sale
Products sold by Sistah Pause are subject to availability. Sistah Pause reserves the right to limit quantities or cancel orders without notice. If an error is made, Sistah Pause may correct it by revising or canceling your order. Product prices may change, and taxes and fees may be applied. Sistah Pause may also update your payment information with new card details provided by your card issuer. You agree to pay all applicable taxes and fees, and Sistah Pause is not responsible for additional bank fees.
Sistah Pause uses a third-party vendor for payment processing and is not liable for their actions. Shipping charges and delivery dates are estimated and not guaranteed. Risk of product loss or damage passes to you once the product is handed to the designated carrier.
Termination
Sistah Pause may terminate your access to the Service at any time without notice for violating these terms or for other reasons, including termination of agreements with third parties involved in providing the Service. Upon termination, certain provisions of this agreement, such as those regarding liability, copyright, and indemnity, will continue to apply. If you attempt to use the Service after termination, you may be held liable for damages.

This includes those arising directly or indirectly from the medical care, services, advice, or treatment provided by the medical providers at Sistah Pause; any failure on your part to disclose relevant information about your medical and physical condition; or harm or injury resulting from medical care, pharmaceuticals, or other treatments provided by Sistah Pause.
You acknowledge being aware of the potential side effects associated with bioidentical hormone replacement therapy (BHRT), hormone replacement therapy (HRT), GLP-1 medications, weight loss medications, supplements, and vitamins provided by Sistah Pause. You accept all risks associated with injectable, oral, and transdermal therapies and agree not to seek indemnification or damages from the Indemnified Parties.
Notices and Electronic Communications
Sistah Pause may provide notices regarding the Service via email, posted notices, or mail. By using the Service, you consent to receiving electronic communications and agree that such communications meet any legal requirement for written notices.
By providing your mobile number, you consent to receive transactional communications related to the Service via text or phone call. You acknowledge that text messaging is not fully secure.
Copyright
It is Sistah Pause's policy to terminate the use of its Service by any User who repeatedly infringes on copyright following a prompt notification from the copyright owner or their legal representative. If you believe your work has been copied and posted on the Service in a way that constitutes copyright infringement, please provide our Copyright Agent with the following details: (1) an electronic or physical signature of the person authorized to act on behalf of the copyright owner; (2) a description of the copyrighted work that you claim has been infringed; (3) a description of the location on the Service of the material that you believe is infringing; (4) your address, telephone number, and email address; (5) a written statement by you that you believe in good faith that the disputed use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. Entire Agreement
This Agreement, along with any other agreements posted on the Service or executed between you and Sistah Pause, constitutes the full and final agreement regarding your use of the Service. It supersedes any previous agreements concerning the use of the Service, including prior versions of this Agreement.
Binding Arbitration / Class Waiver
All disputes, controversies, or claims arising from or related to this Agreement will be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules in New York State (NYS). By agreeing to this arbitration clause, both parties waive their right to a jury trial, class actions, and representative court actions. Arbitration means referring a dispute to one or more impartial individuals for a final decision, following AAA's established procedures.
Before arbitration, we recommend attempting to resolve any issues directly by contacting us at info@sistahpause.com. If resolution cannot be reached, you may proceed to arbitration, provided you send notice to us first. Any dispute must be initiated within one year of the occurrence or as permitted by law. Disputes must be resolved individually, and class or collective arbitrations are not allowed. The arbitrator cannot consolidate claims or conduct representative proceedings.
Both parties agree to maintain confidentiality during the arbitration process, as required by law. If any part of this arbitration agreement is deemed invalid, the remaining provisions will still apply.
YOU AND WE AGREE that any legal claim, dispute, or controversy between you and Sistah Pause, its affiliates, providers, or labs, whether related to the platform, services, or products, will be resolved exclusively through confidential binding arbitration under AAA’s Consumer Arbitration Rules. By agreeing, you waive your right to a jury trial or a court case, except as allowed here. This includes disputes arising before or after this Agreement.
If a dispute arises, both parties agree to attempt informal resolution first, using methods like teleconferences or videoconferences. Arbitration may be initiated if no resolution is reached within 30 days.
General: The performance of the Company under this Agreement may be delayed or interrupted due to causes beyond its reasonable control, including but not limited to acts of God, government actions, war, civil disorder, fire, power failure, equipment failure, labor disputes, or inability to obtain necessary supplies. Governing Law and Venue
This Service is operated by Sistah Pause from our New York office, and users accessing the Service from other locations are responsible for compliance with local laws. This Agreement will be governed by the laws of the State of New York, without regard to conflicts of law provisions.
No Agency Relationship
This Agreement does not create any partnership, joint venture, employment, or agency relationship between you and Sistah Pause. You do not have the authority to bind us in any way.
Assignment
